Registering a brand name in a category that already has another brand with the same name

Here’s my situation. I’m setting up a new brand, “Example”. I’ve got the logos attached to my products, the domain name, and on the way to getting the trademark filed with USPTO (the search shows no conflict).

However, upon applying for the GTIN Exemption (https://sellercentral.amazon.com/gtinx/browser), the eligibility check shows error 5461 and that I cannot apply for ASINs. If I’m not wrong, this implies that there is already an existing brand on BR using the same name “Example” under the same product category.

My question is – does this mean I am screwed and I should cut losses by starting under an entirely different brand name? Or will Amazon allow 2 brands with the same name to exist under the same product category when I contact support?

They haven’t been responsive to my issue and it’ll be great if anyone has advice on this. Thanks!
